Social Security Disability Hearings are held by the Office of Hearing Operations of the Social Security Administration. The Office of Hearing Operations is part of the Administrative process that adjudicates and issues hearing decisions where cases have been heard by an Administrative Law Judge (ALJ). These hearings are scheduled in advance with mailed notifications to Claimants stating when and where their cases will be heard by an Administrative Law Judge(ALJ). The ALJ scheduled to hear your case is not bound by any prior decision made at earlier stages of your case. At the Hearing Level, the ALJ considers all the medical evidence of record, your testimony, the Social Security Administration Regulations and caselaw, to determine whether or not you meet, equal and/or satisfy their eligibility guidelines. These hearings are recorded. They are confidential. Your testimony is taken under oath or affirmation. It is important to be truthful at these hearings so that the ALJ can get a clear picture of your conditions, impairments, limitations, and disabilities alleged in your application and medical documentation.
In order to make sure that your case is evaluated properly and treated fairly, you should be represented by an attorney, who can properly prepare your case. Having an attorney who knows how to develop and address all the issues that you may be confronted with, can make the difference. Whether you are filing a new application for benefits, need to appeal a denial, or need representation at your hearing, or thereafter, you should be represented by an attorney, who can help you at every stage of the legal process. Major advance preparation is necessary for success. This is not an easy process. You should not attempt to deal with this alone.
It is important to have an attorney representing you in your Social Security Disability case, regardless of what stage of the administrative process your case may be. You need an attorney who knows the law, knows your case, and who can gather the appropriate medical evidence and raise the proper objections, at the right time, to help you win your case and get you the best results. For 30 years, I have handled several Social Security Disability Insurance (SSDI) and Supplemental Security Income (SSI) cases involving a variety of impairments, conditions, and limitations for Claimants.
