Treatment is important in disability cases. Consistent treatment, following physician orders, taking required medications, helps Social Security Administration evaluate your case and determine the severity of your physical and/or mental impairments.

Recent Federal Court Decisions

M.H. v. Commissioner of SSA– W.D. Pa- UPDATE
On April 30, 2021, a decision was issued by the United States Western District Court of Pennsylvania, vacating the ALJ’s decision, and remanding the case back to the ALJ for a new hearing. UPDATE: A Fully Favorable Decision was issued on September 23, 2022, after a Remand Hearing determining that the Claimant’s onset of disability began January 24, 2018, up to the present date.

R. v. Commissioner of SSA – W.D. Pa- UPDATE
This case was remanded twice by the United States Western District Court of Pennsylvania for a new hearing to address the mechanical application of the eligibility requirements in borderline situations, when a Claimant’s birthday is so significantly close, to the age categories of the Commissioner’s guidelines. UPDATE: A Fully Favorable Decision was issued on March 17, 2022, after a Remand Hearing granting the Claimant’s benefits from June 13, 2018, to the present date.

D.M. v. Commissioner of SSA – W.D. Pa- UPDATE
On May 18, 2021, this case was remanded by the United States Western District Court of Pennsylvania for a new ALJ hearing. UPDATE: A Fully Favorable Decision was issued on 03/04/2022, after a Remand Hearing granting the Claimant’s disability benefits.

T. v. Commissioner of SSA – W.D. Pa- UPDATE
On March 31, 2020, a decision was issued by the United States Western District Court of Pennsylvania, vacating the ALJ’s decision, and remanding the case back to the ALJ for a new hearing. UPDATE: A Fully Favorable Decision was issued on 10/28/2020, after a Remand Hearing of all the medical issues regarding the Claimant, a Medical Expert testified that the Claimant’s onset of his psychological impairment began September 2014 up to the present date.

C.M. v. Commissioner of SSA – W.D. Pa- Remanded
On September 8, 2021, this case was remanded by the United States Western District Court of Pennsylvania for a new ALJ hearing. In this case, the ALJ failed to consider all of the Claimant’s impairments in combination. Please stay tuned for updates regarding this case.
